Legal Provisions on Smoking Control Should Be Included in the Amendment of the Railway Law | CBCGDF Proposals to 2024 “Two Sessions”

The China Biodiversity Conservation and Green Development Foundation (CBCGDF) held the “2024 Proposal Meeting for the Two Sessions” on February 1, 2024.The "Two Sessions" Proposal Working Group of CBCGDF welcomes active suggestions from all sectors of society to provide more high-quality suggestions for promoting biodiversity conservation and green development.

 


The meeting invited many representatives National People's Congress representatives and members of the National Committee of the Chinese People's Political Consultative Conference who are concerned about ecological environment resources, health, pollution control, and environmental legal construction. The meeting was live streamed with a total of 157,000 online attendees.

 

As the main artery of national transportation, the environmental conditions of railways constantly affect the health and safety of people. However, smoking is still uncontrollable in many regular-speed trains in carriages, on platforms, and other places. In response to this, the Policy and Law Department of CBCGDF submitted a proposal suggesting to include legal provisions on smoking control in the amendment of the Railway Law:

 

1. Smoking and the use of electronic cigarettes should be prohibited in indoor public places such as in trains and indoor public places in railway stations.

 

2. Railway transportation enterprises should take effective measures to ensure that smoking is prohibited in indoor public places and train carriages, and to protect passengers and railway transportation enterprise staff from the hazards of second-hand tobacco smoke.

 

3. Smoking should be prohibited in railway stations and station waiting areas.
