CBCGDF’s Proposal to 2024 “Two Sessions” | Amending Environmental Protection Law to Relax the Conditions for Social Organizations to Carry out Environmental Public Interest Litigation

The China Biodiversity Conservation and Green Development Foundation (CBCGDF) held the “2024 Proposal Meeting for the Two Sessions” on February 1, 2024. The “Two Sessions” Proposal Working Group of CBCGDF welcomes active suggestions from all sectors of society to provide more high-quality suggestions for promoting biodiversity conservation and green development.

 

The meeting invited many representatives National People’s Congress representatives and members of the National Committee of the Chinese People’s Political Consultative Conference who are concerned about ecological environment resources, health, pollution control, and environmental legal construction. The meeting was live streamed with a total of 157,000 online attendees.

 

At the meeting, the Policy and Law Department of CBCGDF shared the suggestion of Amending Environmental Protection Law to Relax the Conditions for Social Organizations to Carry out Environmental Public Interest Litigation”. The main contents are: Public interest litigation filed by social organizations as the main body has shown a sharp decline, and social organizations are generally afraid to sue, unable to sue, and do not want to sue. There are many reasons for this phenomenon, including a legal root problem, that is, the two conditions specified in Article 58 of the Environmental Protection Law. In particular, the second condition will become a weapon to suppress social organizations by certain powerful groups whose interests are touched by public interest litigation filed by social organizations. Therefore, it is proposed to amend Article 58 of the Environmental Protection Law to set the threshold conditions for social organizations to initiate public interest litigation only from the two aspects of business capacity and subject qualification.
