New Mineral Resources Law Should Add a Chapter for Ecological Restoration of Mining Areas | CBCGDF Legal Working Committee Submitted 28 Suggestions

With the leap-forward development of mineral resource exploration, the Mineral Resources Law has been revised twice since its implementation. However, the current law is no longer able to meet the requirements for strategic deployment of mineral resources and ecological protection in mining areas. There is urgent need to revise the structure and content of the current law. On December 29, 2023, the Legal Affairs Committee of the Standing Committee of the National People's Congress released "Mineral Resources Law of the People's Republic of China (Revised Draft)" and has widely solicited opinions from the public.

 


The "Revised Draft" has a special chapter to deploy the ecological restoration work in mining areas, which is a highlight of this revision and one of the focuses of the Legal Working Committee of the China Biodiversity Conservation and Green Development Foundation (CBCGDF). CBCGDF attaches great importance to this revision and, after careful study, has submitted 28 suggestions regarding chapters on general provisions, mining rights, mineral resource exploration and mining, ecological restoration in mining areas, mineral resource reserves and emergency response, and legal responsibilities.
