Ma Yong: China’s Legal Progress in Combating Waste Trafficking | China-France Month of Environment

On October 18, 2023, the 12th France-China meetings of Law and Justice Week, a seminar with the theme of "Combating Waste Trafficking" was held at the Embassy of the French Republic in China. Ma Yong, Deputy Secretary-General of the China Biodiversity Conservation and Green Development Foundation (CBCGDF), participated at the invitation and delivered a speech on the topic.

China was once the world's largest importer of "foreign garbage". In the process of importing large amounts of "foreign garbage", caused serious pollution to the environment and seriously threatened the health of Chinese people. In response, China has launched a long-term crackdown on waste trafficking. Based on the background, Ma Yong, Deputy Secretary-General of CBCGDF, made remarks on "China's Legal Progress in Combating Waste Trafficking". 

The speech basically can be divided into three parts: First, the basic progress and current situation of China's environmental legal system in combating illegal trafficking. Second, introduce the entire legal system in combating illegal waste trafficking in China. Last is to share some typical case studies related to the topic.

Since the implementation of the new Environmental Protection Law in 2015, China has attached great importance to environmental protection and adopted a series of effective environmental protection systems, especially administrative law enforcement measures. Starting in 2020, the three departments including the Supreme People's Procuratorate, the Ministry of Public Security, and the Ministry of Ecology and Environment have carried out "two strikes" special action for four consecutive years. For example, the special action has already filed and investigated more than 2,500 environmental pollution criminal cases, and more than 4,400 criminal suspects were arrested. Besides, the organization like China Biodiversity Conservation and Green Development Foundation, also play a role in filing environmental public interest litigation in accordance with the new environmental protection law.

The second aspect is from the perspective of the legal system. In China, the legal system to combat waste trafficking is basically formed. According to the Constitution and relevant laws and administrative regulations as support, with the assistance of local governments in issuing and implementing local regulations, A comprehensive legal system can be formed and ensure it can be implemented effectively.

In the third aspect, Ma Yong shared three different cases in China that are related to illegal waste trafficking. 

Overall, China now attaches great importance to environmental protection, especially in combating waste trafficking. Therefore, during the process, China is also looking forward to cooperating with other countries more closely, helping each other, and sharing some successful experiences in ecological and environmental protection with the international community at the same time.
