China Supreme People's Court Issued the Interpretation on Several Issues Concerning the Application of Law in the Trial of Ecological and Environmental Tort Liability Disputes

The Supreme People's Court of the People's Republic of China held a press conference and issued the "Interpretation on Several Issues concerning the Application of Law in the Trial of Ecological and Environmental Tort Liability Disputes", which come into force on September 1, 2023.



The "Interpretation" consists of 29 articles, which mainly stipulates the scope of ecological environmental infringement cases, the principle of liability, the infringement of several persons, the subject of responsibility, the responsibility, and the statute of limitations.

In terms of the scope of cases, Article 1 and Article 2 of the Interpretation stipulate the scope of ecological environmental infringement cases in a positive and reverse way respectively.

The Interpretation adheres to the judicial concepts of ecological priority, green development and systematic protection of the Civil Code and environmental protection law, gives full play to the functions of loss filling and damage prevention of the tort liability system on the basis of balancing right relief and freedom of behavior, highlights the value orientation of ecological environmental protection, and promotes the concept of harmony between man and nature to take root in the trial work.
