China's First "Energy Law" Officially Promulgated, CBCGDF Suggestions Adopted

On November 8, 2024, the "Energy Law of the People's Republic of China" was passed by the 12th meeting of the Standing Committee of the 14th National People's Congress and will come into effect on January 1, 2025. The "Energy Law" is a basic and leading law in the energy field. It is of great and far-reaching significance for further consolidating the legal foundation of the energy industry, ensuring national energy security and promoting green and low-carbon transformation.

 


 

Since the National Energy Administration solicited opinions from the public on the "Energy Law (Draft for Comments)" in 2020, the Legal Working Committee of the China Biodiversity Conservation and Green Development Foundation (CBCGDF) has been contributing to the legislative process of the law, and has submitted suggestions on the "Energy Law (Draft for First Review)" and "Energy Law (Draft for Second Review)".

 

Among them, CBCGDF's suggestion to the "Energy Law (Draft for Comments)" that "the provisions should strive to be clear and specific to enhance the operability of the law"; the suggestion to the "Energy Law (Draft for Comments)" that "the general provisions should be adjusted to optimize the structure of the system"; the "environmental safety" suggestion put forward to the"Energy Law (Draft for Comments)"; the suggestion to the "Energy Law (Draft forFirst Review)"to add a "reward clause"; the "biomass-related suggestions" put forward to the "Energy Law (Draft for Second Review)"; and the suggestion to the " Draft for Second Review " to add "implementation of gradient energy consumption, peak-valley prices and other price adjustment policies" were all adopted.
