The Ministry of Ecology and Environment Solicits Opinions on the “Ecological Environment Monitoring Regulations" | CBCGDF Legal Working Committee Puts Forward Many Suggestions

 In order to improve the ecological environment monitoring and evaluation system, in accordance with the "Environmental Protection Law of the People's Republic of China" and relevant laws and regulations, the Ministry of Ecology and Environment organized the drafting of the "Ecological Environment Monitoring Regulations (Draft for Comments)" and solicited public opinions.

 


The Regulations are divided into seven chapters, with a total of 45 articles, namely general provisions, ecological environment quality monitoring, pollution source monitoring, monitoring data quality assurance, supervision and management, legal liability, and supplementary provisions. The focus is on establishing systems such as ecological environment monitoring point management, pollution source monitoring management, monitoring data quality assurance, and monitoring agency supervision and management.

 

The Legal Working Committee of the China Biodiversity Conservation and Green Development Foundation attaches great importance to the solicitation of opinions on the Draft. After careful study, it puts forward three general suggestions and fifteen specific suggestions.

 

The overall suggestions of the CBCGDF Legal Working Committee are shared as follows:

 

First, it is recommended to add relevant regulations on "third-party monitoring services".

 

Second, issues related to monitoring qualifications.

 

Third, it is recommended to divide pollution source monitoring into fixed pollution source monitoring and mobile pollution source monitoring.
