Mr. MA Yong, CBCGDF Deputy Secretary-General: Reflections on Environmental Public Interest Litigation | Discussion on the 10th Anniversary of the Implementation of the New Environmental Protection Law and Environmental Public Interest Litigation
On December 28, 2024, the 10th anniversary of the implementation of the new Environmental Protection Law and a discussion meeting on environmental public interest litigation were held at Beijing Union University. The Legal Working Committee of the China Biodiversity Conservation and Green Development Foundation (CBCGDF) was a supporting organization of the meeting, and Mr. MA Yong, Deputy Secretary-General of CBCGDF, delivered a speech on the theme of "Phase-by-stage review, reflection and outlook of environmental public interest litigation".
The speech focused on the phased review, reflection and prospect of environmental public interest litigation. The reflection part deeply analyzed the problems highlighted in the theoretical research and legislation of environmental public interest litigation, explained the significant slowdown of environmental public interest litigation by social organizations.
It can be seen from the periodic review that environmental public interest litigation has played a very important role in promoting the entire environmental protection work. If these important roles are played, does that mean that there are no problems with the entire environmental public interest litigation? Not really. In the reflection part, I will report to you from three aspects.
The first is the theoretical research and legislative issues of environmental public interest litigation. Second, from an objective social perspective, environmental public interest litigation initiated by social organizations has slowed down significantly. The third reflection is the lack of coordination and even conflict among the various complaints.
