CBCGDF-OceanWetlands Submits 4 Proposals on Fisheries Law (Draft Amendment)
Currently, the National People's Congress (NPC) is seeking public comments on the Fisheries Law (Draft Amendment). The OceanWetlands Group of China Biodiversity Conservation and Green Development Foundation (CBCGDF) has responded positively to the call and, after careful study and discussion, has submitted 4 proposals for reference in its scientific decision-making.
Article 1
It is recommended that “promoting high-quality development of fisheries” be more clearly related to “adapting to the needs of socialist modernization and people's life”. For example, the connotation of high-quality development can be further clarified, such as promoting the sustainable utilization of fishery resources, scientific and technological innovation and intelligent development, and the green transformation of the fishery industry. It is recommended that the specific objectives of “high-quality development” be clearly defined.
Article 4
It is recommended that the “localized and focused approach” be elaborated in more detail. For example, the fishery resource endowment, development mode, resource consumption and ecological carrying capacity of specific regions should be clearly considered. Fishery production activities in different regions should have regionalized characteristics, rather than relying solely on the macro-principle of “adapting to local conditions”.
Article 9
Suggestion: With regard to the hierarchical management and delineation of responsibilities of the competent fisheries and fisheries administration departments, the coordination mechanism between departments can be further clarified, so as to avoid gaps or overlaps in administrative responsibilities. At the same time, for fishery resources management across administrative regions, coordination mechanisms and information sharing mechanisms should be specified so as to effectively solve problems in cross-regional fishery resources management.

It is recommended that the Fisheries Law of the People's Republic of China consider such a legislative approach:
It is recommended that the concept of “sustainable fishing” be explicitly introduced and that international imports of products that do not meet the requirements of “sustainable fishing” be authorized to be sanctioned through the newly amended Fisheries Law. For fishery imports from countries identified as problematic, we have the right to review them under the newly amended Fisheries Law and urge the country to take measures to address the identified problems.
