7 Suggestions from CBCGDF Legal Working Committee Adopted by The Ministry of Ecology and Environment in the "Measures for the Supervision and Management of Sewage Outlets into the Sea

On October 2, 2024, the Ministry of Ecology and Environment issued the "Measures for the Supervision and Management of Sewage Outlets into the Sea (Trial)", which is scheduled to take effect on January 1, 2025.

In order to strengthen the supervision of sewage outlets into the sea and promote the continuous improvement of the quality of the marine ecological environment, on November 25, 2022, the Ministry of Ecology and Environment compiled the "Measures for the Supervision and Management of Sewage Outlets into the Sea (Trial) (Draft for Comments)"and publicly solicited opinions from the society. The Legal Working Committee of the China Biodiversity Conservation and Green Development Foundation (CBCGDF) attaches great importance to this and, after careful study, puts forward 15 suggestions for revision.

Compared with the "Management Measures", the 7 suggestions of the CBCGDF Legal Working Committee were adopted.

For example, the provisions of Article 4, Paragraph 2 of the "Management Measures" that "if multiple responsible entities share a sewage outlet into the sea, the management classification shall be strictly determined in principle" is the adopted suggestion of the CBCGDF Legal Working Committee.

The provisions of Article 8 of the Management Measures on the “setting of sewage outlets into the sea” adopted the suggestion of the CBCGDF that “the setting of sewage outlets into the sea should strictly comply with the environmental impact assessment system”.

Article 8 of the Management Measures stipulates that "the setting of sea discharge outlets" adopts the suggestion of CBCGDF - "the setting of sea discharge outlets should strictly comply with the environmental impact assessment system". In Article 8 of the Management Measures, "If a construction project needs to set up a sea discharge outlet, and its environmental impact report (form) has been verified and approved in accordance with the requirements of relevant national technical specifications, the responsible party does not need to conduct a separate demonstration of the setting of the sea discharge outlet, and provide the approval opinion number of the environmental impact assessment of the construction project when filing", which is completely consistent with the suggestions of the CBCGDF Legal Working Committee.
