CBCGDF Volunteers Reveal Illegal Fishing in Dongting Lake Area May Reach Hundreds of Kilograms a Day? | CBCGDF Legal Working Committee: Illegal Fishing Must Be Held Accountable

Recently, the Legal Working Committee of the China Biodiversity Conservation and Green Development Foundation (CBCGDF) received a message from volunteers that some people were fishing illegally in Dongting Lake by fishing and electric trawling, and the catch could reach hundreds of kilograms a day.

Dongting Lake, located in the middle reaches of the Yangtze River, is the second largest freshwater lake in China, covering an area of 2,579.2 square kilometers. Due to its rich fishery resources, it was once the place with the richest fishery resources in the country. For a long time, due to human activities such as water pollution, overfishing, and beach reclamation, the living environment of aquatic organisms has deteriorated, and the biodiversity index has continued to decline. Rare aquatic animals such as the Chinese sturgeon (Acipenser sinensis) and the Yangtze River Porpoise (Neophocaena asiaeorientalis) are facing a population extinction crisis.

In order to conserve and restore the fishery and aquatic biological resources in the Yangtze River Basin, including Dongting Lake, and promote the restoration of the ecological environment in the Yangtze River waters, on January 6, 2019, the Ministry of Agriculture and Rural Affairs, the Ministry of Finance, and the Ministry of Human Resources and Social Security jointly issued the "Implementation Plan for the Ban on Fishing and the Establishment of a Compensation System in Key Waters of the Yangtze River Basin", proposing a ten-year fishing ban plan. On December 27, 2019, the "Notice of the Ministry of Agriculture and Rural Affairs on the Scope and Time of the Ban on Fishing in Key Waters of the Yangtze River Basin" was issued. According to the notice, large lakes connected to the river, such as Poyang Lake and Dongting Lake, "will implement a 10-year annual fishing ban from 0:00 on January 1, 2021 at the latest, during which productive fishing of natural fishery resources will be prohibited."

In order to protect natural fishery resources, the "Yangtze River Protection Law" and the "Fisheries Law" both stipulate strict legal responsibilities for illegal fishing that violates the fishing ban period, fishing ban area, and fishing ban period in key waters. There are two major criteria for judging whether the ecosystem of rivers, lakes, and reservoirs is healthy: one is to look at the water, and the other is to look at the fish. The fishing ban in the Yangtze River is not just to protect natural fish resources, but more to protect and balance the aquatic ecosystem in the Yangtze River waters. The 10-year fishing ban in the Yangtze River has been implemented for three years, but illegal fishing still occurs in Dongting Lake, a key protected area in the Yangtze River Basin. The CBCGDF Legal Working Committee hopes that the local government in the Dongting Lake Basin will strengthen supervision and carry out ecological law publicity for local fishermen to better protect the local aquatic ecological environment and biodiversity.
