CBCGDF Wrote to the Ministry of Ecology and Environment: Wind Power and Photovoltaic Power Generation Projects Should Strengthen Biodiversity Conservation

On October 17, 2024, the General Office of the Ministry of Ecology and Environment issued the Notice on Strengthening Ecological and Environmental Protection of Onshore Wind Power and Photovoltaic Power Generation Construction Projects (Draft for Comments) for public comments.

The China Biodiversity Conservation and Green Development Foundation (CBCGDF) attaches great importance to this. Based on the Biodiversity Friendly Photovoltaic Project Standards issued and implemented by the CBCGDF, it organized discussions and believed that the "Notice" (Draft for Comments) is insufficient in the implementation of laws and regulations, lacks important content of ecological design and soil and water conservation, focuses on environmental protection and ignores the biodiversity impact and risk prevention and control of project construction and operation, which may have an adverse impact on China's carbon peak and carbon neutrality work.

In response, the CBCGDF Comprehensive Technology Department wrote to the General Office of the Ministry of Ecology and Environment, suggesting that the ecological and environmental protection of onshore wind power and photovoltaic power generation construction projects should be comprehensively strengthened. The following are the main suggestions:

1. Strictly implementing relevant laws and regulations

The "Notice" does not emphasize relevant laws and regulations, but laws and regulations are an important support for ecological and environmental protection, providing a certain legal basis and normative guidance for ecological and environmental protection.

2. Biodiversity conservation should be emphasized

The "Notice" proposes that the rationality and effectiveness of countermeasures and measures to prevent or mitigate adverse environmental impacts should be put forward in the preparation of the planning environmental impact report, but no specific explanation of the adverse environment is given. Biodiversity is an important indicator of environmental change. Therefore, it is recommended to change "prevent or mitigate adverse environmental impacts" to "prevent or mitigate adverse environmental impacts such as biodiversity damage".

3. It is suggested to encourage ecological design of wind power and photovoltaic power generation products

Designing eco-friendly products is conducive to protecting the ecological environment and saving natural resources. It should be an important part of strengthening the ecological and environmental protection work of onshore wind power and photovoltaic power generation projects. In addition, the "Guiding Opinions on Carrying out Ecological Design of Industrial Products by the Ministry of Industry and Information Technology, the National Development and Reform Commission, and the Ministry of Environmental Protection" issued by the Ministry of Industry and Information Technology, the National Development and Reform Commission, and the Ministry of Environmental Protection also emphasizes the importance of ecological design.

4. Ecological and environmental protection needs to integrate the power of the public

Public participation is an important part of environmental impact assessment. Therefore, it is necessary to seek the opinions of experts and society when preparing the planning environmental impact report. In addition, information disclosure is conducive to social supervision. By disclosing information, the public can better understand the environmental protection work and supervise it to ensure the scientificity, effectiveness and legality of ecological environmental protection behavior. Therefore, the annual report on environmental protection compiled by the construction unit should not only be submitted to the local ecological environmental supervision department, but also be made public to the society to seek public supervision.
